10-003 02/24/82 POWERS OF THE COLLEGE (POLICY) The Corporation is empowered: 1. To buy, own, sell, convey, assign, mortgage, or lease any interest in personal property, and to lease any real property from the Oglala Sioux Tribe and others for such periods as may be authorized by law, and to hold, manage, or sub-lease the same; 2. To borrow money and issue evidence of indebtedness in furtherance of the purposes of the Corporation and to secure the same mortgage, pledge, or other lien upon its property; 3. To do and perform all acts reasonable and necessary to accomplish the purposes of the Corporation, including the execution of such agreements and other instruments and undertakings as may be necessary or appropriate to enable the Corporation to carry out its purposes as set forth in Article IX and to secure financing from governmental and private agencies in the form of grants or loans or to accept gifts, for such purposes; 4. To grant post secondary degrees and certificates, especially the degree of Associate of Arts and to develop curricula leading to such degrees or certificates; 5. To enter into agreements with all public and private agencies, including universities and colleges providing higher education meeting the needs of members of the Oglala Sioux Tribe; 6. To sue and be sued in its corporate name in a competent court to the extent allowed by law, the Oglala Sioux Tribal Council hereby giving its irrevocable consent to allowing the corporation to sue and be sued upon any contract, claim or obligation arising out of the construction, operation, or maintenance of any educational institution undertaken by the Corporation to waive any immunity from suit which it might otherwise have, provided, however, that the Oglala Sioux Tribe shall not be liable for the debts or obligations of the Corporation, except insofar as it may hereafter expressly obligate itself in writing.
