12-003 MEMBERSHIP OF THE CORPORATION (POLICY) The membership of the Corporation shall consist of thirteen (13) persons. Each elected member shall be a member of the Oglala Sioux Tribe and a resident of the district or village represented. All members shall serve until the election or due appointment of their successor. Nine (9) members of the Corporation shall be elected directly for a term of four (4) years by members of the Oglala Sioux Tribe qualified to vote in the general election. One member is to be elected from the following districts and villages: Eagle Nest, Pass Creek, Wakpamni, LaCreek, White Clay, Wounded Knee, Porcupine, Medicine Root and Pine Ridge Village. (Amended by OST Ordinance 02-14) The members from Eagle Nest, Pass Creek, White Clay, Wounded Knee and Pine Ridge Village will be elected in alternate tribal primary elections from the members representing Wakpamni, LaCreek, Porcupine and Medicine Root districts. One member with voting rights who shall not be an Oglala Sioux Tribal Council member shall be appointed by the Oglala Sioux Tribal Education Committee and serve at the Education Committee's pleasure. (Amended by OST Ordinance 02-14) One member with voting rights who shall not be an Oglala Sioux Tribal Council member or the Tribal President shall be appointed by the Oglala Sioux Tribal President and serve at his/her pleasure. (Amended by OST Ordinance 02-14) One member with voting rights shall be appointed by Oglala Lakota College's Council of Elders. (Amended by OST Ordinance 02-14) One member with voting rights shall be a student who shall annually be elected by the Student Senate, pursuant to the Student Senate Constitution and BY-Laws, and will serve for a term of one calendar year. (Amended by OST Ordinance 02-14) Any elected member may be removed for cause by a majority of the electorate of the districts or village he/she represents either through written petition or recall election. Any elected member may also be removed for three (3) unexcused absences within a one-year period. The Council shall fill any vacancy created by death, resignation, or removal for cause, of an elected member by itself electing a new member who shall serve the balance of the unexpired term. Any removal of an appointed Board member shall be filled by the charter thereof approved by Ordinance 71-01 of Oglala Sioux Tribal Council, as amended. Any member of the Board of Trustees considering employment with Oglala Lakota College shall resign from Board membership prior to his application being considered for employment. COMPOSITION The Boards of Trustees shall be composed of the persons serving at any time as members of the Board of Trustees of the Oglala Lakota College as provided in the charter thereof approved by Ordinance 71-01 of the Oglala Sioux Tribal Council, as amended.
